 I received an e-mail a short time ago from my friends at the Environmental Defense Action Fund advising me that the House of Representatives passed "Protecting States’ Rights to Promote American Energy Security Act" (HR 2728), a bill that would block federal environmental standards of hydraulic fracturing on federal lands. I have e-mailed my U.S. Senators and am asking you to do the same. TIME IS OF THE ESSENCE. Either way, please act immediately.

Dear (ENTER YOUR SENATORS NAME HERE),

I'm writing today to ask you to oppose a Senate version of the recently passed House bill, the "Protecting States' Rights to Promote American Energy Security Act" (HR 2728).

This Senate bill, which is being circulated by Utah Senator Orrin Hatch, would block all federal regulation of hydraulic fracturing on federal lands. It is a wild over-reaction to the modest problem of jurisdictional overlap with the states. A policy of removing all federal oversight for hydraulic fracturing on public lands is ripe with unintended and dangerous consequences for environmental and public health.

Many of these important areas cross state boundaries or are adjacent to scenic National Parks.  Some aspects of oil and gas development--such as groundwater pollution and air emissions--have cross-jurisdictional implications, and in these instances there is a clear need for federal oversight.

Commonsense adjustments to the rules proposed by the Bureau of Land Management (BLM) can help harmonize overlapping state and federal rules. Let's not rashly disregard long-standing oversight of public lands by federal land management professionals on issues with clear cross-state implications or on questions where BLM, like any other property owner, ought to have a big say in what happens on the land it manages.

I urge you to oppose the Hatch bill and to work constructively to promote stronger standards on the natural gas industry to protect communities and our natural environment.
